Terms of Service

These terms govern your use of viavaii.com and the video production service we provide ("the Service"). By creating an account or buying credits, you agree to them. We operate from Italy; for anything about your data, see our Privacy Policy.

The Service

You send us a reference ad, your product and the footage we ask for on the shot list. Our team analyzes it, writes a script, and edits your footage into a finished vertical video. Every project moves through a fixed set of steps on your project board, and nothing moves forward past a review step until you approve it.

Accounts

You need an account to use the Service. You're responsible for keeping your login credentials safe and for what happens under your account.

Credits and plans

The Service runs on credits: you either buy a one-off credit package or subscribe to a monthly plan that grants a fixed amount of credits each billing cycle. Producing a video and using standalone tools (e.g. generating text, combining two videos) consumes credits at the rate shown on the pricing page at the time of use.

Payments

All payments are processed by Stripe. Prices are shown in the currency displayed at checkout. Subscriptions renew automatically each billing period until cancelled; you can cancel anytime from your account, which stops the next renewal.

Cancellations and refunds

You can cancel a project and get your credits back for it at any time before our team has started working on it (i.e. before an agent has been assigned and begun the analysis/script/edit steps).

Once a project has entered production, it is no longer eligible for a refund — the credits allocated to it are not returned, in whole or in part, regardless of how far the project has progressed. This reflects the fact that the Service produces custom work starting from your own material, not a stock product. By starting a project you acknowledge and accept this before any credits are consumed.

Unused credits sitting in your wallet that were never allocated to a project you cancel are not affected by the above and remain usable.

Your content

You keep ownership of the footage, images and material you send us, and of the final video we deliver to you. You give us the license we need to use that material to produce your project — nothing more. You confirm you have the rights to whatever you send us (footage, music, likeness of people appearing in it, etc.) and that it doesn't infringe anyone else's rights or break the law.

Acceptable use

Don't use the Service for content that is illegal, infringing, or that you don't have the rights to. We can refuse or stop work on a project that breaks this rule.

No warranty, limitation of liability

We work in good faith to deliver a video that matches your brief, but we don't guarantee specific results (e.g. ad performance, view counts, sales). To the extent allowed by law, our liability for any claim related to the Service is limited to the amount you paid us for the project in question.

Changes

We may update these terms as the Service evolves; the version in force is always the one published here. If we make a material change, we'll let you know before it applies to a project you've already started.

Governing law

These terms are governed by Italian law. Any dispute that can't be resolved directly will be subject to the exclusive jurisdiction of the Italian courts, without prejudice to any mandatory consumer-protection rights you may have in your country of residence if you are a consumer within the EU.
